Who May Use This Limited Warranty?

Luminance Medical Ventures, Inc. (“Company”) warranties apply to Company’s products purchased through glowbiepets.com (“Product” or “Products”). This limited warranty applies to consumer use only and does not apply when the Product is used in a commercial or institutional setting.

The Company warrants the Products against defects materials and workmanship when used normally in accordance with the applicable instructions for use provided in the operating and service manual for the Product during the applicable warranty period. During the warranty period, Company will repair or replace, at no charge, Products or parts of Products that prove defective because of improper material or workmanship, under normal use and maintenance.

The Company may change the availability of this limited warranty at its discretion, but any changes will not be retroactive.

What Will We do to Correct the Problems?

If during the applicable warranty period you submit a valid claim to the Company, Company will, at its option, (i) repair the Products at no charge, using new or refurbished replacement products or parts of Products, or (ii) replace the Product with a functionally equivalent product at no charge, or (iii) exchange the Product for a refund of the purchase price. Shipping and handling charges may apply except where prohibited by applicable law.

Within the first 90 days after initial purchase, the Company will be responsible for all shipping costs related to your request, within the original country the order was shipped to. If you're no longer located within the country the order was originally shipped to, shipping costs will be your responsibility.  After the first 90 days, you will be responsible for Product shipping charges and related coverage while in transit to Company. 

Any replacement Product will be warranted for the remainder of the original warranty period.

How Long Does the Coverage Last?

The warranty period for Company Products depends on your purchased Products and starts from the date of purchase. The Glowbie Crate comes with a 1-year limited warranty. 

What Does the Limited Warranty Not Cover?

This limited warranty does not apply to: (a) cosmetic damage; (b) damage caused by failure to follow the Product instructions or to perform any preventive maintenance; (c) modifications; (d) unauthorized repair; (e) damage due to transportation; (f) damage due to liquid contact; (g) damage due to storage; (h) theft or loss of the Product; (i) defects caused by normal wear and tear or otherwise due to the normal aging of the Product; and (j) to damage due to external causes such as accidents, abuse, damage by natural causes like lightning, floods, or other natural disasters, or other actions or events beyond the reasonable control of the Company. In addition, component parts or products manufactured by a third party (“Third Party Product”) may constitute, contain, be contained in, incorporated into, attached to or packaged together with, the Product. Third Party Products are not covered by the limited warranty, and the Company makes no representations or warranties with respect to any third-party product, including any (a) warranty of merchantability; (b) warranty of fitness for a particular purpose; (c) warranty of title; or (d) warranty against infringement of intellectual property rights of a third party; whether express or implied by law, course of dealing, course of performance, usage of trade, or otherwise.

What do You Have to do?

To obtain warranty service, you must first submit a request to our customer support team here or via email at info@luminancemedical.com. Once completed in its entirety, our service team will contact you via email to provide support.

Troubleshooting

Please note, in order to proceed with a warranty-related request, our service team may ask you to comply with various troubleshooting tasks.

Service and Repair

In the instance your device should require service and/or repair, our team will provide additional instructions for the Product(s) to be shipped to our service center. All services and/or repairs must be completed by authorized Company technicians. Upon completion of our post-service testing, the Product(s) will be shipped back to you.

Before receiving warranty service, we may require that you furnish proof of  purchase details.

Implied Warranties

Except to the extent prohibited by applicable law, all implied warranties (including, without limitation, warranties of merchantability and fitness for a particular purpose) shall be limited in duration to the duration of the applicable warranty period. Some jurisdictions do not allow limitations on the duration of an implied warranty, so the above limitation may not apply to you.

Limitation of Liability

Except as provided in this warranty and to the maximum extent permitted by law, the Company is not responsible to you or any third party for direct, special, incidental or consequential damages resulting from any breach of express or implied warranty or condition, or under any other legal theory, including but not limited to loss of use; loss of revenue; loss of actual or anticipated profits (including loss of profits on contracts); loss of the use of money; loss of anticipated savings; loss of business; loss of opportunity; loss of goodwill; loss of reputation; loss of, damage to, compromise or corruption of data; or any indirect or consequential loss or damage howsoever caused including the replacement of equipment and property. The Company’s liability shall under no circumstances exceed the actual amount paid by you for the defective product. Some jurisdictions do not allow the exclusion or limitation of special, indirect, incidental or consequential damages, so the above limitation or exclusion may not apply to you.

The foregoing limitations shall not apply to death or personal injury claims, or any statutory liability for intentional and gross negligent acts and/or omissions.

Governing Law

This limited warranty shall be governed by the laws of the State of Texas without regard to its conflict of law provisions.

Risk of Loss

You agree to use the Products only in the manner for which they are intended and in compliance with the instructions and warnings set forth in the operating and service manual included with the Products. You are responsible for, and assumes all risk of, loss or theft of, or damage to, the Products provided to it hereunder. The Products shall be covered by the warranty set forth in the operating and service manual included with the Products. Except as set forth in the operating and service manual, Company makes no warranty, express or implied, including but not limited to any implied warranty of merchantability or fitness for a particular purpose, and specifically disclaims all liability for indirect or consequential damages.

Indemnification

You agree to defend, indemnify, and hold harmless Company, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, suits, actions, demands, disputes, allegations, or investigations brought by any third party, governmental authority, or industry body, and all liabilities, damages, losses, costs, and expenses, including without limitation reasonable attorneys’ fees, arising out of or in any way connected with (i) your access to or use of the Company website, including, without limitation, your access to or use of any information presented on or through the Company website, (ii) your user contributions to the Company website, (iii) your breach or alleged breach of any warranties made by you hereunder or your violation of any other provision of these terms, or (iv) your violation of any law or the rights of a third-party. Company reserves the right to assume control of the defense of any third-party claim that is subject to indemnification by you, in which event you will cooperate with Company in asserting any available defenses.
